2. Data Controller

We process personal data in accordance with the applicable legal provisions of Montenegro and – where relevant – the principles of the EU General Data Protection Regulation (GDPR). Personal data means any information relating to an identified or identifiable natural person.

3. Hosting and Server Logs

When you access our website, information is automatically transmitted by your browser to our server (server log files). This includes the IP address, date and time of the request, time zone difference, referrer URL, pages/files accessed, HTTP status code, browser type/version and operating system. Processing is carried out to ensure the technical provision, stability and security of the website. The legal basis is our legitimate interest in the secure and unimpaired operation of the website. Log data is stored only for a short period on a regular basis and then deleted, provided there is no relevance for security purposes.

4. Content Management and Page Builder: Elementor Pro

Our pages are created using the page builder plugin “Elementor Pro”. Elementor may set functional cookies/local storage entries for display, caching and responsive behaviour. No independent profiling is carried out by us. Processing takes place to ensure a user‑friendly, fast and stable presentation of the website (legitimate interest). Insofar as optional features set cookies, this only occurs with your consent via the cookie banner.

5. Booking System: MotoPress Hotel Booking

For enquiries and bookings, we use the MotoPress booking plugin. The data you enter is processed, in particular: name, contact details (email address, telephone number), stay details (travel period, number of persons), payment and/or billing information (where required), as well as the content of your messages.

Purposes: Processing enquiries, preparing and fulfilling the rental/accommodation contract, communication and, where applicable, compliance with statutory retention obligations. Legal basis: the performance of pre‑contractual measures and fulfilment of the contract; where statutory obligations apply, compliance with legal requirements; in all other respects, our legitimate interest in the efficient handling of bookings.

Retention period: In accordance with the statutory retention periods and for as long as is necessary for contract execution, billing and any warranty or liability claims.

External recipients: Payment service providers (where used), and IT/hosting providers within the scope of commissioned data processing. Data is transferred to third countries only where a legal basis exists (e.g. standard contractual clauses) or where the service is operated in Montenegro / the EU."

6. Correspondence and Contact Forms

When you contact us via form or email, we process the data you provide in order to handle your enquiry and any follow‑up. Legal basis: pre‑contractual measures and/or our legitimate interest in responding to enquiries. The data is deleted once your enquiry has been fully processed, provided there are no statutory retention obligations that require longer storage.

7. Google Fonts Used Locally

For consistent display we use Google Fonts that are hosted locally on our own server. No connection is made to Google’s servers when the site is loaded. This means that no personal data is transmitted to Google in the context of providing the fonts.

8. Cookies, Consent-Management: Real Cookie Banner

We use “Real Cookie Banner” as our consent management solution. The tool stores your consent decision so that proof of consent and its administration can be ensured. For this purpose, technically necessary cookies/local storage entries are set (e.g. consent status, timestamp, categories). Legal basis: our legal obligation to document consent as well as our legitimate interest in legally compliant consent management. Optional services/cookies are only activated after you have given your consent.

You can change or withdraw your consent at any time with effect for the future via the settings in the cookie banner.

9. Payment Processing (if used)

If an external payment service provider is used, payment data is processed directly between you and the payment service provider. We only receive transaction‑relevant information (e.g. status, masking of card details) to the extent necessary for performance of the contract and accounting. Legal basis: performance of the contract and compliance with legal obligations (e.g. tax and retention requirements).

10. Recipients and Processors

We use service providers for hosting, maintenance, email, booking system and consent management. These providers process data solely in accordance with our instructions (data processing on our behalf) and are contractually obliged to comply with data protection requirements.

11. Transfers to Third Countries

Data is only transferred to third countries where a legal basis exists, in particular when using services with server locations outside Montenegro/the EU. In such cases, we ensure appropriate safeguards (e.g. standard contractual clauses) or use local/EEA hosting options.

12. Data Retention

Personal data is stored only for as long as necessary for the respective purposes, including statutory retention periods (e.g. tax and commercial law). After this period, the data is deleted or anonymised.

13. Rights of Data Subjects

You have the following rights within the scope of the applicable legal provisions: the right of access, rectification, erasure, restriction of processing, data portability, to object to processing based on legitimate interests, and to withdraw any consent you have given with effect for the future.

We implement appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access or disclosure. These measures include, among others, access controls, encryption and regular updates.

15. Mandatory Disclosures for Bookings/Accommodation

Bookings and stays may be subject to statutory reporting or registration obligations (e.g. guest registration). In such cases, we process the data required to fulfil these obligations and forward it to the competent authorities.

16. Minors

Our services are not directed at children under the age of 16. Personal data of minors is only processed with the consent of their legal guardians where this is required by law.

17. Changes to this Privacy Policy

We may amend this privacy policy if our processes or the legal framework change. The version published on this website at any given time shall apply.
